By accessing our Website, browsing our products, or placing an order, you agree to be bound by these Terms. Please read them carefully before making a purchase. If you do not agree to these Terms, please do not use our Website or place an order .

In these Terms, unless the context otherwise requires:

  • Australian Consumer Law” or “ACL” means Schedule 2 of the Competition and Consumer Act 2010 (Cth).

  • Consumer” has the meaning given in section 3 of the ACL.

  • Goods” means the products, including headwear, footwear, apparel (including t-shirts, jerseys, hoodies, tank tops, and crop tops), and any other items listed for sale on our Website.

  • Order” means a request by you to purchase Goods from us via our Website.

  • You” and “Your” means the person accessing or using the Website, or placing an Order.

2. Application of Terms

2.1. These Terms apply to all use of our Website and all contracts for the supply of Goods by us to you.
2.2. By placing an Order, you confirm that you have read, understood, and accept these Terms and agree to be bound by them .
2.3. Any terms or conditions included in your Order that deviate from or are inconsistent with these Terms are expressly rejected by us and will not form part of the contract .

3. Orders and Formation of Contract

3.1. Acceptance of Orders: All Orders placed by you are an offer to purchase Goods from us. We reserve the right to accept or reject any Order for any reason, including but not limited to product availability, errors in pricing or product description, or suspected fraud . A binding contract will only come into existence when we communicate our acceptance of your Order (e.g., by sending an Order Confirmation email) or when we dispatch the Goods .
3.2. Order Accuracy: You are responsible for ensuring the accuracy of all information provided in your Order, including the product selection, size, colour, and delivery address. We are not liable for any errors made by you during the ordering process.
3.3. Order Cancellation by Us: We may cancel any Order at any time prior to dispatch. If we cancel your Order, we will notify you and provide a full refund of any amounts paid.

4. Products and Pricing

4.1. Product Descriptions & Imagery: We endeavour to display our Goods and their descriptions, colours, and sizing as accurately as possible. However, we do not warrant that product descriptions, images, or other content on the Website are entirely accurate, complete, or error-free. Due to varying screen resolutions, the actual colours of Goods may differ from how they appear on your device.
4.2. Pricing: All prices displayed on our Website are in Australian Dollars (AUD) and are inclusive of Goods and Services Tax (GST) unless otherwise stated . We reserve the right to change prices at any time without notice. However, the price you pay will be the price displayed at the time you place your Order. Any promotional offers, discounts, or codes are subject to their specific terms.
4.3. Price Errors: In the event a Good is listed at an incorrect price due to an error, we reserve the right to cancel any Orders placed for that Good at the incorrect price, even after an Order Confirmation has been sent. We will notify you of such cancellation and provide a refund if payment has been made.
4.4. Taxes and Duties: Prices are GST inclusive for Australian customers. For international Orders, you are responsible for any customs duties, taxes, or other charges imposed by the destination country. We are not responsible for any such charges, delays, or holds placed by customs authorities.

5. Payment

5.1. Payment Methods: Payment must be made in full at the time of placing an Order. We accept payments via PayPal, Stripe, and other methods listed on our checkout page .
5.2. Payment Processing: By providing payment details, you confirm that you are authorised to use the selected payment method. We use third-party payment gateways (PayPal and Stripe) to process payments. We do not store your full credit card or other financial details on our servers. You agree to be bound by the terms and conditions of these payment gateways.
5.3. Fraud Prevention: We employ security measures to protect against fraudulent transactions. We may contact you for verification purposes and reserve the right to refuse or cancel any Order if we suspect fraudulent activity .

6. Shipping, Delivery and Risk

6.1. Shipping & Timeframes: We will deliver Goods to the address you provide at checkout. Shipping costs and estimated delivery times are provided at checkout and are estimates only. While we aim to dispatch orders promptly, we are not responsible for delays caused by shipping carriers, customs clearance, or other factors beyond our control .
6.2. Risk of Loss: Risk of loss or damage to the Goods passes to you upon dispatch of the Goods from our warehouse . This means we are not responsible for loss, theft, or damage to the Goods during transit. Please ensure your delivery address is secure and suitable for receiving parcels.
6.3. Shipping Insurance: We recommend that you obtain shipping insurance for your delivery if you are concerned about loss or damage in transit.
6.4. Non-Delivery: If your Order is not delivered within the estimated timeframe, please contact us via the details in clause 18. We will assist you in tracing the shipment.

7. Returns, Refunds and Repairs

IMPORTANT NOTICE: YOUR AUSTRALIAN CONSUMER LAW RIGHTS

Our Goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Goods repaired or replaced if the Goods fail to be of acceptable quality and the failure does not amount to a major failure .

The following policy is subject to your rights under the ACL, which cannot be contracted out of .

7.1. Major Failures

A product has a major failure if it:

  • Is unsafe.

  • Is significantly different from the description or sample shown.

  • Would not have been purchased by you if you had known about the problem.

  • Does not do what it is supposed to do and cannot be fixed easily.

Remedy for Major Failure:
If a product has a major failure, you may choose a refund or replacement. The refund must be the full amount you paid, in the same method as you paid . We will also reimburse you for any reasonable return shipping costs.

7.2. Minor Failures

A product has a minor failure if the issue can be fixed within a reasonable time and does not significantly impact its use or value.

Remedy for Minor Failure:
If the problem is minor, we may choose to repair the product for free. If we are unable to repair it within a reasonable time, you may then request a refund or replacement.

7.3. Change of Mind

We are not required by law to offer a refund or exchange if you simply change your mind, find the product cheaper elsewhere, or ordered the wrong product .
However, as a goodwill gesture, we offer a Change-of-Mind policy under the following conditions:

  • Items must be returned within 30 days of purchase.

  • Items must be unused, unworn, unwashed, and in their original condition with all tags and packaging intact.

  • Return shipping costs for change-of-mind returns are your responsibility.

  • We may offer a store credit or exchange (at our discretion), not a cash refund, for change-of-mind returns.

Sale items are not eligible for change-of-mind returns unless they are faulty, as your ACL rights remain for faulty sale items .

7.4. What is NOT Covered by This Policy

Our returns policy does not cover:

  • Damage caused by misuse, neglect, improper care, or accidents.

  • Normal wear and tear.

  • Damage caused by improper washing, drying, or ironing.

  • Goods that have been altered or modified in any way.

7.5. How to Request a Return

To initiate a return for any reason, please contact us via email at [Insert Email Address] with your order number and a description of the issue. Our team will provide you with a Return Authorisation and instructions. Do not return goods to us without obtaining prior authorisation.

7.6. Proof of Purchase

We require proof of purchase (e.g., order confirmation email, receipt) to process all returns, refunds, and exchanges . If you can provide adequate proof, you are still entitled to a remedy even without a physical receipt.

7.7. Return Shipping Costs

  • For Faulty Items (under ACL): We will reimburse you for reasonable return shipping costs. Please keep your postage receipt.

  • For Change-of-Mind Returns: You are responsible for all return shipping costs .

7.8. Restocking Fees

We will not charge a restocking fee for returns of faulty items under the ACL . We reserve the right to apply a reasonable restocking fee for change-of-mind returns, which will be communicated to you before the return is processed.

8. Consumer Guarantees and Warranties

8.1. Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies the application of the ACL or any other law, the provisions of which cannot be excluded, restricted, or modified.
8.2. Warranty Against Defects: For Goods we supply that are manufactured by third parties, we will pass on to you any manufacturer’s warranty, to the extent that it is transferable. Our liability for a breach of a condition or warranty implied by law into these Terms is limited, to the extent permitted by law, to one of the following: the replacement of the Goods or the supply of equivalent Goods; the repair of the Goods; or the payment of the cost of having the Goods repaired .

9. User Accounts and Acceptable Use

9.1. Account Creation: You may be required to create an account to place an Order or access certain features of our Website. You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. Please notify us immediately if you suspect any unauthorised use of your account .
9.2. User Conduct: You agree not to:

  • Use our Website for any unlawful or fraudulent purpose.

  • Interfere with or disrupt the operation of our Website or servers.

  • Attempt to gain unauthorised access to any part of our Website or systems.

11. Limitation of Liability

11.1. ACL Compliance: To the fullest extent permitted by law, subject only to any express provision in these Terms, our total liability to you for any claim arising from or in connection with these Terms or the supply of Goods is limited to the price paid by you for the Goods in question .
11.2. Exclusion of Consequential Loss: To the full extent permitted by law, we will not be liable to you or any other person for any loss of use, profit, revenue, interest, or goodwill, or for any indirect, incidental, or consequential damages suffered or incurred by you or any other person .
11.3. Consumer Guarantees: This clause 11 has effect subject to the ACL, and nothing in this clause excludes, restricts, or modifies the application of any provision of the ACL that cannot be excluded, restricted, or modified .

12. Privacy and Data Protection

12.1. Our handling of your personal information is governed by our Privacy Policy, which forms part of these Terms. Please review it to understand how we collect, use, store, and protect your data .
12.2. By using our Website and placing an Order, you consent to us collecting, using, and disclosing your personal information in accordance with our Privacy Policy.

13. Force Majeure

We will not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure is caused by events beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemic, natural disasters, government actions, or failure of third-party suppliers or carriers (“Force Majeure Event”) . If a Force Majeure Event occurs, our obligations are suspended for the duration of the event, and we will take reasonable steps to mitigate its effects.

14. Dispute Resolution and Governing Law

14.1. Governing Law: These Terms are governed by and construed in accordance with the laws of New South Wales, Australia . You and we agree to submit to the exclusive jurisdiction of the courts of New South Wales for any disputes arising from or relating to these Terms or your use of our Website.
14.2. Dispute Resolution: In the event of a dispute relating to these Terms or the supply of Goods, the parties agree to first attempt to resolve the dispute informally by contacting each other via the details provided in clause 18. If the dispute cannot be resolved within 14 days, the parties may seek mediation or other alternative dispute resolution processes before commencing legal proceedings.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be severed from the Terms, and the remaining provisions will continue in full force and effect .
